The action, filed in the Southern District of New York, centers on claims that the company concealed critical regulatory and operational risks.

Alibaba Faces Class Action Lawsuit Over Alleged AI Data Misconduct

The legal complaint, captioned Wistisen v. Alibaba Group Holding Limited, alleges that the company and its executives violated the Securities Exchange Act of 1934 by failing to disclose ties to the Chinese Ministry of Industry and Information Technology. Plaintiffs argue that these omissions left shareholders unaware that Alibaba was categorized as a Chinese military company under the National Defense Authorization Act. Furthermore, the suit addresses claims that Alibaba utilized thousands of fake accounts to access Anthropic’s Claude AI models, conducting unauthorized distillation attacks to train its own proprietary technology.

The market reacted sharply to these revelations in mid-2026. On June 8, the U.S. Department of Defense designated Alibaba as a Chinese military entity, triggering a 3.9% drop in share price over two trading sessions. A second decline of 4.7% followed on June 24 after reports emerged regarding the alleged AI model theft. Hagens Berman partner Reed Kathrein, who is leading the investigation, stated that the firm is examining whether executives intentionally misled the market about the company’s true risk profile.
