X Corp. Battles Startup to Keep the Twitter Brand Buried

Elon Musk’s X Corp. has launched a legal offensive against Operation Bluebird, a startup attempting to seize the defunct Twitter trademark. The lawsuit, filed Tuesday, accuses the newcomers of attempting to capitalize on the platform’s remaining goodwill by rebranding their own site under the legacy name and familiar bird motif.

The conflict ignited last week when Operation Bluebird petitioned the U.S. Patent and Trademark Office to cancel X Corp.’s ownership of the "Twitter" and "Tweet" marks. The startup claims the company legally abandoned the brand by transitioning to the X identity. Operation Bluebird has already begun soliciting handle reservations on its own site, Twitter.new, which X Corp. argues creates a deceptive association between the two entities.

X Corp. maintains that its rebrand does not constitute an abandonment of rights. Legal filings highlight that millions of users still access the platform via the legacy twitter.com domain and continue to use the term "tweet" in daily parlance. By targeting the startup for trademark infringement, the company seeks a court order to halt Bluebird’s usage and invalidate their pending trademark application.

Stephen Coates, general counsel for Operation Bluebird and a former Twitter attorney, counters that the company effectively killed the brand through its own aggressive rebranding efforts. However, industry observers suggest the litigation signals a protective stance. Trademark attorney Josh Gerben notes that while X Corp. may have attempted to bury the Twitter legacy, the company is clearly unwilling to let a competitor dig it up.
